Marsh Landing Approval Overturned

As a result of community testimony shared during Board of Appeals hearings on December 4 and December 10, the approval of the final site plan for the Marsh Landing subdivision has been overturned.

“The developer now will have resubmit a more environmentally friendly plan that will protect the yellow perch spawning habitat within the Cattail Creek wetlands,” Magothy River Association President Paul Spadaro wrote in an email. “Working together, we can protect and restore the Magothy for generations to enjoy!”

Residents from the Berrywood community became staunch opponents of the plan, citing their belief that stormwater controls proposed by the developer would not protect the wetlands, causing environmental damage to an area that Berrywood has worked to restore. During the hearings, the project engineer admitted that stormwater would not be completely contained and would reach Asbury Road.

The burden would have fallen on the residents to inspect and maintain the rain gardens and slot drain after every significant rain event.
